The object of this Bill was to enable the Aboriginal Protection Board to function more effectively, and to safeguard the health of the Aboriginals and of the community generally. The Bill suggests that the law regarding Aboriginals in NSW should be brought into line with the law in Queensland, South Australia and Western Australia in the interests of proper administration. It further proposed to add methylated spirits to the definition of 'liquor'.

The Aborigines Protection Act 1909 (NSW) was the first law in NSW that specifically authorised the removal of Aboriginal children from their families. It continued to exercise control over Aboriginal people and their children until 1969. Separate systems of child welfare existed for Aboriginal and non-Aboriginal children throughout this period.

As early as 1810, laws banned the sale or supply of alcohol to Aboriginal people. This continued under the Aborigines Protection Act 1909 (NSW). It was not until 1963 that it was legal for all Aboriginal people to be supplied alcohol in NSW.

In 1909, the Aborigines Protection Board became the owner of all reserves. The Board had control over who could, and could not, live on a reserve. Board officials, including Board employees and NSW police officers, had direct control over the lives of Aboriginal people on reserves.
